1. Application
The present terms & conditions apply to all transactions made by customadenglish.com. Any person or company who validates a purchase via our sales platform online, pays by check, or pays in cash is considered a client. The only version of this document that is legally binding is the version available on this present page.
2. Eligibility
Age limitations apply. Customadenglish.com does not accept clients younger than 18 years of age. Even if the content of our products and services is not shocking or explicit, we prefer to address a mature audience. Any client who purchases a product and is not a minimum of 18 years of age will be removed from the program, without reimbursement.
3. Purchases
If you wish to purchase any service made available through the Service (“Place Order & Pay”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete. You expressly agree that Customadenglish is not responsible for any loss or damage arising from the submission of false or inaccurate information. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
4. Price
Prices are indicated in Euros, tax included. We refund the price in euros, so it is possible that there is a difference in the price you paid and the amount refunded if your account is in a currency that is not euros. We do not control the exchange rates. Prices can be modified at any moment. Prices listed on our sites will be the prices applied at checkout.
5. Payment
When you purchase on customadenglish.com, payment is immediate, at the date of purchase. You can make payment directly via our sites, which are protected for secure online payments. Online payments are managed by Wix Payment (Refer to "Wix Payments Terms of Service"). All guarantees regarding the security of these systems are entirely the responsibility of these sites and your bank and do not concern us. If your company is paying for your program, we will invoice your company at the end of the month of your enrollment. Payment is due within 30 days from the date indicated on the invoice.
6. Cancellation and Reimbursement conditions

Cancellation of a single lesson:

Can be canceled up to 24 hours before it begins for a full refund or reschedule.

If canceled less than 24 hours in advance, the lesson is lost.

Cancellation of a single lesson within a pack:

Similar to canceling a standalone lesson, but it's noted that you may reschedule instead of receiving a refund.

Cancellation of a 10/5-lesson pack subscription:

Allows cancellation within 14 days of purchase with different refund conditions:

No lessons booked yet: Full refund.

First lesson booked but canceled 24 hours in advance: Full refund.

First lesson booked but canceled less than 24 hours in advance: Lose one lesson, refund for remaining ones.

One or more lessons already taken: 75% refund for the remaining lessons.

No refund after 14 days from purchase.

7. Expiration dates to use your lessons

For the 5 lessons pack, you have 3 months from the date of purchase to use your lessons. Past this date, your lessons expire, and you can no longer use them (unless agreed otherwise).

For the 10 lessons pack, you have 6 months from the date of purchase to use your lessons. Past this date, your lessons expire, and you can no longer use them (unless agreed otherwise).

In the case of other agreements, we will communicate this to you in writing.
8. Protection of personal information

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content solely for the purposes of engaging in English lessons and related activities offered by Custom-made English. This license does not permit you to copy, reproduce, modify, distribute, display, perform, or create derivative works based on the Service or any of its content without prior written consent from Custom-made English.
Any unauthorized use of the Service or its content may violate copyright, trademark, and other applicable laws and may result in legal action.
Custom-made English reserves all rights not expressly granted in these Terms and Conditions, and no license or right is granted to you by implication or estoppel.

11. Indemnification
You agree to defend, indemnify, and hold harmless Custom-made English and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

In no event shall Custom-made English, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Without limiting the generality of the foregoing and notwithstanding any other provision of these terms, under no circumstances will Custom-made English ever be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to your use of the Service, these Terms, the subject matter of these Terms, the termination of these Terms, or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by Custom-made English or any person for whom Custom-made English is responsible, and even if Custom-made English has been advised of the possibility of such loss or damage being incurred.
